Terms of Service

1. Who we are

“Nex-Gen Performance,” “we” and “us” mean the business co-owned by Nabil Milani and Andreas Tsaousis that offers youth and adult soccer, goalkeeper and sports-performance training in Northern Virginia. “You” means the person using our website or apps.

These Terms cover the website and apps. Training sessions themselves may also come with their own agreement or waiver.

2. Who can use the apps

• Under 13: a child under 13 can't have their own account. A parent or guardian creates and manages the account, and is responsible for it.
• 13 to 17: you need a parent's or guardian's permission, and they must agree to these Terms for you. Parents and guardians are responsible for how their child uses the apps.
• Coaches: Nex-Gen Coach is for coaches on the Nex-Gen Performance team.
• You can't use the apps if we have removed you before.

3. Your account

• You sign in with a one-time code sent to your email. Keep your email secure: anyone who can read it can sign in to your account.
• Give accurate information, including your age, and keep it up to date.
• One person per account. Don't share your account or use someone else's.
• You can browse as a guest. Some features, like messaging and session requests, need an account.
• Tell us right away at nexgenperformance99@gmail.com if you think someone else is using your account.

4. What the apps do

The Nex-Gen app lets you follow our academy, see our coaches and programs, message coaches (text and photos), request sessions, ask the in-app assistant questions, find coaches and facilities near you, and get notifications. We may add, change or remove features at any time. Some features, like payments, are not available yet.

5. Session requests and bookings

• A session request, whether it comes from the app, the assistant or our website, is a request, not a booking. A session is booked only when a coach confirms the time, place and price with you.
• If you need to cancel or reschedule, tell your coach as early as you can.

6. The AI assistant

• The assistant's answers are generated by AI models run by third-party providers. They can be wrong, incomplete or out of date. Check anything important with a coach.
• The assistant can't book, cancel or change a session on its own. It passes your request to a coach, and the coach confirms.
• It does not give medical advice. For injuries or health questions, talk to a doctor.
• Don't share sensitive personal information with it. Our Privacy Policy explains how assistant chats are handled.

7. Messaging and conduct

Keep messages respectful and about training. You agree not to:

• harass, threaten, bully or intimidate anyone;
• send sexual, hateful or violent content, or anything else inappropriate for young athletes;
• try to get around the app's protections for minors, including the limits on messaging athletes under 18;
• pretend to be someone else, or misstate your qualifications;
• send spam or advertising;
• share someone else's personal information or photos without their permission (or their parent's, for a minor);
• upload content you don't have the right to share, or viruses or other harmful code;
• try to reach accounts, data or systems you aren't allowed to, or scrape, copy, reverse engineer or disrupt the apps or website;
• use the apps or website for anything illegal, or help anyone else do any of this.

Coaches see what you send them. We may review messages and content when looking into a report, to protect a minor, or when the law requires it, and we may remove content or suspend accounts that break these rules. Use the app's report and block tools, or email nexgenperformance99@gmail.com, to report a problem.

8. Child safety

We have zero tolerance for child sexual abuse or exploitation, including grooming, sexual content involving a minor, and child sexual abuse material. We remove it, permanently close the account, report it to the National Center for Missing & Exploited Children (NCMEC) as US law requires, and cooperate with law enforcement.

If a child is in immediate danger, call 911. You can also report to NCMEC's CyberTipline at report.cybertip.org or 1-800-843-5678. Report any concern to us at nexgenperformance99@gmail.com; you don't need an account.

9. Your content

• You own the photos, messages and other content you put in the apps (“your content”).
• You give Nex-Gen Performance permission to store, display, copy (for example, to resize a photo) and send your content as needed to run the apps and the services you ask for, such as showing your profile photo to coaches or delivering your messages. This permission is worldwide, royalty-free and non-exclusive. It ends when you delete the content or your account, except for copies we must keep, as described in our Privacy Policy.
• We won't use your photos, or photos of your athlete, in our marketing or social media without your permission.
• You are responsible for your content and must have the right to share it. Only share photos of other people, especially minors, with their permission (or their parent's).
• We may remove content that breaks these Terms.

10. Health and safety

Sports training is physical and carries a risk of injury, including sprains, strains, fractures and concussions. Before training, make sure the athlete is healthy enough to take part, and talk to a doctor if you're unsure. Tell your coach about any injury, condition or medication that could matter.

Information in our apps and on our website, including assistant answers, is general and is not medical advice.

11. Payments

Payments are not live in the app yet. When they launch, card payments will be processed by Stripe under Stripe's terms, and we will add our payment terms (prices, refunds and cancellations) here before then.

12. Our apps and content

The Nex-Gen Performance name and logo, the apps and the website, including the text, design, photos and videos we provide, belong to Nex-Gen Performance or the people who licensed them to us. We give you a personal, limited, non-transferable permission to use the apps and website for their intended purpose. Don't copy, sell or reuse our content without our permission.

13. Other services

Our apps and website link to or rely on other services, such as Apple, Google, Instagram, maps and the service providers listed in our Privacy Policy. We aren't responsible for their content or practices, and their own terms apply when you use them.

14. Apple and Google

If you got the app from Apple's App Store: these Terms are between you and Nex-Gen Performance, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for handling any claims about it (including product, legal-compliance or intellectual-property claims). If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; Apple has no other warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you got the app from Google Play: Google has no obligation or liability for the app or these Terms.

15. Ending your account

You can delete your account in the app at any time. It is deactivated right away and permanently deleted after 30 days; our Privacy Policy has the details. We may suspend or close an account that breaks these Terms or puts others at risk, especially minors. Parts of these Terms that by their nature should continue (such as your responsibility for your content, the disclaimers and the limits on liability) continue after your account ends.

16. Disclaimers

We work hard to keep our apps and website accurate and running, but we provide them “as is” and “as available.” We don't promise that they will always be available, error-free or secure, or that all information in them (including coach profiles, schedules and assistant answers) is accurate. To the extent the law allows, we disclaim implied warranties, such as merchantability and fitness for a particular purpose. Nothing in these Terms limits rights you have under law that can't be waived.

17. Limits on our liability

To the extent the law allows, Nex-Gen Performance and its owners, coaches and staff are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data, arising from your use of our apps or website. Our total liability for any claim about the apps or website is limited to the greater of $50 or what you paid us for the app in the 12 months before the claim. These limits don't apply where the law doesn't allow them, such as for gross negligence or willful misconduct.

18. If you cause a claim

If you break these Terms or the law, or misuse our apps or website, and that leads to a claim against Nex-Gen Performance, you agree to cover our reasonable costs of that claim, including legal fees, to the extent the law allows.

19. Disputes and governing law

If you have a problem with us, email nexgenperformance99@gmail.com first. Most issues get solved quickly that way.

These Terms are governed by the laws of [to confirm: Virginia]. Disputes we can't resolve informally will be heard in the courts of [to confirm: Virginia].

20. Changes to these Terms

We may update these Terms. We will change the effective date, and for significant changes we will tell you in the app or by email before they take effect. If you keep using our apps or website after that, the new Terms apply. If you don't agree, stop using them and delete your account.

21. General

• We may send you notices electronically, by email or in the app, and they count as written notice.
• If part of these Terms can't be enforced, the rest still applies.
• If we don't enforce a term right away, we can still enforce it later.
• You can't transfer your rights under these Terms. We may transfer ours if Nex-Gen Performance is sold or reorganized.
• These Terms and our Privacy Policy are the whole agreement between you and us about the apps and website.
